Terms of Service — CallPilot AI (BTW Marketing)

1. Scope of Application

These Terms of Service apply to all services provided by BTW Marketing (hereinafter referred to as "CallPilot"), in particular the CallPilot AI phone assistant. By using the service, you accept these terms.

2. Service Description

  • AI-powered phone assistant for incoming and outgoing calls
  • Automatic appointment scheduling and lead qualification
  • CRM integration and call transcription
  • 24/7 availability according to the chosen tariff
  • Dashboard access for evaluations and configuration

3. Customer Obligations

  • Correct provision of company data during registration
  • Compliance with all applicable laws, in particular the nDSG and the Telecommunications Act
  • No abusive use of the service (spam, fraud, illegal content)
  • Securing access data and immediate reporting in case of misuse
  • Ensuring that callers are informed in accordance with nDSG Art. 19

4. Prices & Billing

Prices are based on the current price list on callpilot.ch/preise. Billing is done monthly in advance. All prices in CHF, excl. VAT. Payment processing via Stripe.

5. Contract Term & Termination

  • Monthly termination with 30 days' notice to the end of the month
  • Annual contracts with 90 days' notice to the end of the year
  • Extraordinary termination in case of serious contractual breaches
  • Data deletion within 30 days after contract termination

6. Limitation of Liability

CallPilot is only liable for damages caused by gross negligence or intent. Liability for indirect damages, lost profits, or data loss is excluded. Total liability is limited to the amount paid in the last 12 months.

7. Availability & SLA

We strive for an availability of 99.5% p.a. (excluding scheduled maintenance windows). In case of non-compliance, pro-rata credits will be granted. No claim for damages.

8. Intellectual Property

All rights to the CallPilot platform remain with BTW Marketing. Customers receive a non-exclusive, non-transferable license to use the service.

9. Confidentiality

Both parties undertake to maintain confidentiality regarding all information exchanged in the course of the business relationship. This obligation continues even after contract termination.

10. Applicable Law & Jurisdiction

Swiss law applies. The place of jurisdiction is Zurich, Switzerland. For consumers, the law of the consumer's place of residence applies.

11. Changes

We reserve the right to adjust these Terms of Service. Changes will be communicated 30 days prior to their entry into force by email. In case of non-acceptance, the right to extraordinary termination applies.
